Downloading music from the internet is mostly considered illegal because it violates the commercial rights of the music industry and artists. Copyright gives the owner the exclusive right to reproduce, distribute, and publicly perform the work. When you download music from an unauthorized source, you are violating this reproduction right. This is especially true for copyrighted files that are shared without authorization (like torrents). The only legal downloading is either by purchasing the work directly or by using licensed platforms such as Spotify within their protected system (offline listening). Any other situation is seen as unauthorized profit and is therefore protected against by law.

This is entirely about money and keeping the industry alive. The music industry has to pay for recording costs, studio fees, production, and marketing. If everyone downloaded music for free, this industry would collapse and new music production would stop. That’s why lawmakers banned unauthorized copying and downloading, in order to protect artists and the industry. You either pay to get the right to listen, or you support the system by watching ads (like Spotify’s free version).

Think of it simply: A baker makes bread. If you steal the bread from the bakery, that is theft. In the digital world, an artist makes a song it’s their product. If you copy and use this product for free without permission, that is the digital equivalent of theft. The law prevents stealing. Therefore, if a work has copyright and you are not explicitly given permission to download it, downloading is illegal.

What makes it illegal is the violation of the "right of reproduction." Laws such as FSEK (Law on Intellectual and Artistic Works) in Turkey give only the creator the authority to copy and distribute a work. If you download music from an unauthorized source (torrents, illegal sharing sites, etc.), you have reproduced a copy of the work without permission. This is a direct violation of the law and a crime. Legally, even for personal use, you cannot make unauthorized copies.

In the past, we used to buy cassettes or CDs, and copying them from cassette to cassette or CD to CD was also technically illegal, but nobody could control it. The internet has made copying extremely easy and fast. Laws were toughened to stop this uncontrolled duplication. The issue is simply the ease of uncontrolled reproduction brought by technology. Legal downloading only happens through licensed sellers.

“Downloading” and “download rights” are two different things. When you download music legally (like Spotify Premium’s offline mode), the file is technically downloaded, but it is encrypted and does not belong to you. You only have the license to use it. Illegal downloading, on the other hand, is usually done in open formats like MP3 or FLAC from sites that copy works without paying royalties. These sites distribute music without the copyright owner’s approval, forming an illegal chain from start to finish. What makes it illegal is that the file is obtained without authorization from the copyright holder.

Downloading music is not always illegal. The main issue is whether the music you download has copyright and whether the copyright holder (usually the artist or the record label) has given you permission to download it.

The core reason is this: When you download a song from the internet without permission, you are stealing the labor of the artist who owns that work. Artists and record labels make money by either selling music (iTunes, Amazon, etc.) or renting it out (Spotify, Apple Music, etc.). If you get it for free and without permission, you are stealing their income. This is called intellectual property theft.
