My friend is in jail, charged with attempted murder. Can anyone tell me how much trouble he is in, and is it possible that he will go to prison?

"i hate to say it...but defense is one thing and hitting a man while he's down is another. Get me? The asshole had it coming...god I've seen it happen...but with a little self control he would be sitting at his house playing xbox right now not cooling it in a cell. Was it worth it? Would I get on a dude and pummel him when he's down? Um not unless I'm good with attempted murder. Whatever the asshole did he didn't deserve to die we can all agree. He needed a few teeth knocked out, not a psychotic "MMA-Style" beatdown. I have a good friend who's a former MMA fighter and current trainer. He can kick and punch so fast you literally wonder if he's a vampire or something. That is a Weaponized Human and that is what the prosecution is going to say. Good luck to your friend and let's hope fratboy asshole pulls through and drops charges. "

As this was not a premeditated act, the charge will be reduced to attempted manslaughter, and a good lawyer could easily get the jail time reduced to probation by showing good intention in protecting the girl (assuming it actually happened as you described it).

Lots of states allow the use of lethal force for preventing sexual assault It's usually applied in the cases where you are a third party to something akin to a rape. It's clear based on what you've said that she was sexually assaulted but it sounds far from a rape or something in the same vein. I'm not a lawyer but attempted murder sounds ridiculous. If it were me, I would claim defense to assault, even if he was not the one assaulted, he was defending someone that was. If it's not too late get lots of pictures of her bruise, you can bet they will have lots of photos of his injuries. Hire a good lawyer, don't fuck around with a murder charge.

I don't know, and I'm a truly evil person at hearth and mind, but that asshole deserved it, except the neurological damage, that's just pushing it too far. A good punch and some broken teeth/nose was enough to teach that IDIOT a lesson.

Their will be a court case and your friend will probably do a little time but less then a couple months probably.
